Terms & Conditions

The following describes the terms under which Household Auctions LLC (“HHA”) offers you access to the HHA services. In order to become a member on the HHA website, you must read and accept all of the terms and conditions set forth below (the “HHA Terms and Conditions”):

  1. As the buyer  you agree that bids placed on the HHA website are a contract and you are responsible for paying all amounts due to HHA. Do not bid if you cannot pay for your won auctions immediately upon their completion and/or pick up the items during the times specified. While using the HHA website, you agree to:
    • Not use the HHA website or any of its services if you are not able to legally enter into a binding contract or if you are under the age of 18 years old;
    • Immediately pay for items purchased by you;
    • Not circumvent or manipulate our fee structure, the billing process, or any fees owed to HHA; or manipulate the price of any item.
  2. All items are sold as is and where is. HHA will in good faith provide a detailed assessment of the condition of all items. However, we understand that our assessment and the buyer’s assessment may differ thus we encourage the buyer to view all items in person.
  3. All auctions are setup with an end date, which is exactly the same for all auctions within an estate collection. All auctions feature an automatic bidding extension system whereby if an item receives a bid within 5 minutes of the auction end time, the auction will be extended 5 minutes from the time the bid is placed to allow equal opportunity for bidding parties to submit bids. The end time will continue to be extended by 5 minutes each time a new bid is placed and the item will not close until 5 minutes have elapsed with no additional bidding activity.
  4. A valid credit card is required to be “on file” for all registered users to place a bid. By providing your credit card information to HHA, you authorize HHA to charge your credit card for the purchase amount of all auctions won via successful bids as well as associated taxes and fees including but not limited to shipping costs (if any), handling fees, insurance fees. In the event that you do not claim your won items, you agree that the previously listed charges will be captured from the credit card on file. You also agree and acknowledge that you will maintain valid credit card information within your user profile so long as you maintain an account with HHA. Purchases over $1,000 using a credit card will be charged an additional 2% surcharge to help cover merchant fees.
  5. Payment is required immediately upon the completion of all auctions for which you are the highest bidder. If you are picking up your items in person, you may pay by cash at time of pick up provided you contact us first to make the necessary arrangements.
  6. HHA is not responsible for the acts or omissions of HHA or other carriers in packing or shipping of purchased lots, whether or not such carrier is recommended by HHA. YOU ALSO AGREE AND UNDERSTAND THAT HHA WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, COMPENSATORY, CONSEQUENTIAL OR EXEMPLARY DAMAGES EVEN IF HHA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT PERMITTED BY LAW, HHA’S TOTAL LIABILITY TO YOU FOR ANY REASON AND UPON ANY CAUSE OF ACTION WHATSOEVER, WHETHER IN CONTRACT, WARRANTY OR TORT, SHALL BE LIMITED TO THE AMOUNT OF MONEYS PAID BY YOU TO HHA HEREUNDER IN THE PRECEDING THREE (3) MONTH PERIOD.
  7. All sales are subject to appropriate state sales tax laws. Tax exempt buyers must provide the appropriate state sales tax exemption certificate prior to the end of the sale.
  8. HHA will ship items at buyer’s expense. Handling and insurance fees will apply. Please contact us for more details.
  9. If, after winning an auction, you are unable to pick up your items during the scheduled removal date and time you must contact HHA 24 hours prior to the scheduled removal date and time to determine if alternate arrangements can be made. THIS SHOULD ONLY BE CONSIDERED AS A LAST RESORT AND ON AN EXCEPTION BASIS. Items which cannot be moved will be forfeited and may be subject to disposal charges in addition to the original invoice amount. HHA, in its sole discretion, may arrange for the transport of the purchased items to one of our warehouses and arrange for an alternate pickup date and time, subject to availability. As stated previously, HHA WILL CHARGE YOUR CREDIT CARD FOR THE PURCHASE AMOUNT, TAXES, AND FEES.
  10. Forfeiture of Items.
    • Failure to Pay. Any items not paid for in accordance with the HHA Terms and Conditions will be forfeited by you and HHA may, in its sole and absolute discretion, resell the items or donate the items to a charity of HHA’s choosing. HHA reserves the right to report your account to collections for the combined total of the original invoice amount and any moving or disposal charges.
    • Failure to Pick-Up Items. IF YOU FAIL TO PICK-UP ANY ITEMS WITHIN FOURTEEN (14) CALENDAR DAYS OF THE CLOSE OF BIDDING YOU WILL BE CONSIDERED TO HAVE FORFEITED THE ITEMS AND TITLE WILL REVERT TO HHA. HHA MAY, IN ITS ABSOLUTE AND SOLE DISCRETION, RESELL THE ITEMS OR DONATE THE ITEMS TO A CHARITY OF HHA’S CHOOSING. HHA RESERVES THE RIGHT TO CHARGE THE CREDIT CARD ON FILE FOR ANY MOVING OR DISPOSAL CHARGES.
  11. Governing Law. This Agreement shall be governed in all respects by the laws of the State of New Jersey, without regard to conflict of law provisions. You agree that any claim or dispute you may have against HHA must be resolved exclusively by a state or federal court located in Bergen County, New Jersey.
